Darcie R. Brault joined the firm as a partner in 2012. Darcie graduated with a Bachelor’s degree with honors from the University of Michigan in 1987. She received a Juris Doctor degree from Wayne State University in 1990. She received the Presidential Scholarship, Board of Governors Scholarship and the Tompkins Award (Graduate Essay Division). She has been a member of the Michigan State Bar since 1990 and is admitted to practice before the United States Supreme Court, the United States Court of Appeals for the Sixth Circuit and federal district courts in Michigan.

Darcie is “AV” rated by Martindale-Hubbell, listed in “The Best Lawyers in America,” “Crain’s Detroit Area’s top Lawyers,” “Michigan Super Lawyers,” and as one of the “Top 50 Women Lawyers in Michigan.”

Darcie practices in all aspects of state and federal employment litigation, including appellate advocacy. She primarily represents workers and has particular expertise in FMLA, ERISA litigation and multi-plaintiff litigation. She has achieved million dollar and multi-million dollar judgments and settlements in single plaintiff and class action claims. Through her advocacy, Darcie has helped shape the state and federal law in cases such as Stokan v. Domino’s Pizza (Washtenaw County Circuit Court), Grace v. USCAR, 2008 U.S. App. LEXIS 6192, Wojan v. Alcon Labs., Inc., 2008 U.S. Dist. LEXIS 69576, FedEx Ground Package Systems litigation, and Caudill v. Sears Transition Pay Plan, 2010 U.S. Dist. LEXIS 52053. Recently, Darcie represented a class of women who were sexually harassed in the fast food industry, resulting in a settlement benefitting nearly 100 women.

Darcie also practices labor law, representing labor unions in federal and state courts, administrative agencies, the NLRB, MERC, and in arbitrations. Darcie has counseled unions through supervised elections and trusteeship proceedings. Darcie represented classes of retirees in a series of retiree healthcare cases.

Darcie is a case evaluator for Wayne and Oakland Counties and an arbitrator with the American Arbitration Association. Darcie is also a former chairperson of the State Bar of Michigan’s Labor and Employment Law Section and served on the Judicial Qualifications Committee for the State Bar of Michigan. She was also a member of the Employment and Legislative Committees of the Michigan Association for Justice, the National Employment Lawyers Association and other professional organizations.

Darcie has lectured on many topics such as FMLA litigation, ERISA class action litigation, application of evidence rules to new technology, caregiver discrimination, retaliation, employment law for workers’ compensation attorneys, joint and successor liability, and the intersection of labor and employment law. Publications include: Employment Litigation in Michigan (ICLE 3d ed. 2015, and annual updates), co-authored Chapter 5, “Discrimination Based on Disability;” since 2015, The Family and Medical Leave Act: Complement to FRD Protection under Title VII/ADA, Lawnotes.
